Make Sure Your Will Is Done The Right Way

Your will is the most important part of your estate plan. It describes who you chose to be your heirs, what they will inherit and when. If you die without a valid will, special laws called intestacy laws take over and decide who will inherit your valuables. Most people in Central Florida would rather take control of the process of inheritance.

At the Law Offices of Mitchell A. Sherman, Esq., I have helped clients draw up and amend their wills as part of their estate planning since 1992. I take the confusion out of the process and make having a complete and legally enforceable will accessible to everybody. I will personally take you through the process, listen to your stated goals and create a will tailored to you.

What Happens If I Don’t Have A Will?

The law calls dying without a will “dying intestate.” Florida has laws that decide where a deceased person’s assets go when they die without a will. This could mean your money and other valuables would go to someone you are not close to or that a person you wanted to inherit from you would get nothing. It could also cause a family fight over what your final wishes might have been.

The Problem With Doing It Yourself

You have probably seen a character in a movie or TV show writing out their own will by hand. Unfortunately, handwritten, self-made wills are invalid in Florida. The state has certain requirements for wills. If your will does not meet these standards, the probate judge will reject it.

Many websites offer cheap fill-in-the-blank template wills. Often, those templates were created by someone who has never practiced estate planning law in Florida. Each state has its own estate planning laws. Using a one-size-fits-all template could leave you with an incomplete or invalid will. You might save a little money now, but it can cause your family a lot of expensive problems later.

I have drafted thousands of wills. I know the law and how to make sure your final wishes will be carried out. Getting it right the first time can save you and your family in the long run. I can help your estate avoid unnecessary taxes and fees so your assets go to the people you love.
